Terms & Conditions
These terms
and conditions form the basis on which you may order from hattorus.com. Please
read them carefully as they contain important information. If you are unable to
find specific information that you are looking for, please contact us at info@hattoria.com
1. SUPPLY OF GOODS
We accept
worldwide purchases, please see our delivery
& returns page
for more details on carriage charges.
2. PAYMENT
Payments are
processed through PayPal and Stripe. No payment details are kept by Hattorus.
3. RISK AND OWNERSHIP
No title of
any goods in an order shall pass to you until we have received payment in full
for the entire order and it has been successfully delivered to you. Once goods
have been delivered to you they will be held at your own risk and we will not
be liable for their loss or destruction.
4. PRICES
The prices
payable for goods that you order are as set out on our website. All prices are
inclusive of VAT at the current rates and are correct at the time of entering
information.
5. AVAILABILITY
Should there
be a problem with the supply of materials required to make your hat, we will
contact you to make you aware of the situation. This could mean a delay in
dispatch but we can discuss should the situation arise.
6. DISPATCHING OF ORDERS
We aim to dispatch all
made to order hats within 20 working days, we aim to dispatch off the shelf
hats in up to 3 working days.
Wherever
possible, goods will be dispatched by Russian Post or Boxberry unless otherwise
requested.
All goods dispatched
require a signature. If no one is in to accept delivery, a neighbour may be
asked to accept the delivery and to sign for it. If unable to deliver to your
address, a card will be left with instructions. No delivery will be left
without a signature. Whenever a courier service is used, delivery may be made
at any time between 08.30 and 17.30.
There may be
slight delays during busy periods.
7.
HANDLING CHARGES
Handling
charges include processing, packaging and delivery and are subject to VAT. Full
details can be found on our delivery
and returns page.
8. CLAIMS
Goods may
only be subject to refund if found defective. Defective goods must be reported
to Hattorus, by telephone, within 2 working days of detection and be returned
to Hattorus, for testing, within 5 working days before any claim may be
considered. Goods damaged in transit or not received on the expected delivery
day must be reported to Hattorus by 12 noon on the day following the
actual/expected delivery date. Claims must also be confirmed in writing within
5 working days. Claims made outside this time frame cannot be considered.
9. RETURN OF GOODS
Please make
sure to measure the head as per instructions to ensure a good fit, and reduce
the probability of a return. Any goods ordered in error must be reported to Hattorus,
within 2 working days of receipt of delivery. They may only be returned with
the agreement of Hattorus and only if they are in re-saleable condition. If
return of goods is agreed to by Hattorus, the client will be issued with a case
number which must be quoted with the shipment. If, upon sight of returned
goods, Hattorus judges them to be in re-saleable condition, your account will
be credited with 80% of their value. If no case number is quoted or goods are
not judged to be in re-saleable condition, no credit will be given. In this
case, goods will only be returned to the client if requested, in which case the
applicable handling charge will be requested via PayPal, or a requested BACS
payment.
10. CANCELLATION BY US
We reserve
the right not to process your order if:
i. Materials
used in the construction of your order are unavailable from our suppliers.
ii. A hat you ordered was listed at an incorrect price due to a typographical
error.
If we do not
process your order for the above reasons, we will notify you by email and will re-credit
to your account any sum deducted by us from your PayPal account as soon as
possible, but in any event within 14 days.
11. NOTICES
Unless
otherwise expressly stated in these terms and conditions, all notices from you
to us must be in writing and sent to our contact email: info@hattoria.com and all notices from us to you
will be displayed on our website from time to time.
12. CHANGES TO LEGAL NOTICES
We reserve
the right to change these terms and conditions from time to time and you should
look through them as often as possible.
13. LAW, JURISDICTION AND LANGUAGE
This
website, any content contained therein and any contract brought into being as a
result of usage of this website are governed by and construed in accordance
with Russian Federation law. Parties to any such contract agree to submit to
the exclusive jurisdiction of the courts of Russian Federation. All contracts
are concluded in English.
14. INVALIDITY
If any part
of these terms and conditions is unenforceable (including any provision in
which we exclude our liability to you) the enforceability of any other part of
these conditions will not be affected.
15. PRIVACY
You
acknowledge and agree to be bound by the terms of our Privacy
Policy.
16. THIRD PARTY RIGHTS
After
purchasing on Hattorus, a customer might receive an email from the third party
company ‘Customer Reviews’ with an invitation to review their order.
17. OTHER IMPORTANT TERMS
Alternative
dispute resolution is a process where an independent body considers the facts
of a dispute and seeks to resolve it, without you having to go to court. If you
are not happy with how we have handled any complaint, you may submit the
dispute for online resolution to the European Commission Online Dispute
Resolution platform.
18. CHANGES TO TERMS AND CONDITIONS
Hattorus
reserves the right to alter any details regarding prices and terms and
conditions without prior notice.
